Full summary

Royal Decree 1312/2024, of 23 December (BOE-A-2024-26931), regulated the Unique Short-Term Rental Register procedure and created the Digital Single Window for Rentals (VUDA). The Supreme Court has partially annulled it through five judgments handed down between May and June 2026.

What has been annulled

The judgments annul the provisions of RD 1312/2024 relating to the Unique Register procedure and the obligation to register with the Land Registry or the Movable Property Registry in order to obtain a registration number that allows short-stay accommodation to be advertised on online platforms. Specifically, articles 1, 2 (paragraphs f and i), 5, 6, 8, 9, 10 and 12.b) of RD 1312/2024 are annulled, in the parts relating to the unique registration procedure.

The legal grounds are jurisdictional: the State lacks competence to impose a national registration procedure linked to the Land Registry in a matter — tourism — that falls within the exclusive powers of the Autonomous Communities.

The five Supreme Court judgments

  • STS 620/2026, of 19 May (BOE-A-2026-12300, published 8 June 2026) — appeal by the Valencian Regional Government (case 143/2025). Lead judgment.
  • STS 629/2026, of 21 May — appeal by APARTUR and ATA of Barcelona and Girona (case 54/2025).
  • STS 649/2026, of 27 May — appeal by the Junta de Andalucía (case 139/2025).
  • STS 669/2026, of 1 June — appeal by the Region of Murcia.
  • STS 697/2026, of 4 June — appeal by ASCAV (Canary Islands).

All five judgments reach the same conclusion: the State lacks competence to impose the obligations linked to the Unique Rental Register provided for in RD 1312/2024.

What remains in force from RD 1312/2024

The judgments expressly recognise the State's competence to regulate:

  • The Digital Single Window for Rentals (VUDA) as a data exchange gateway.
  • Online platform data transmission obligations.
  • Data transmission for statistical purposes.

RD 1312/2024 therefore subsists in the parts not affected by the annulment. It is not correct to say that the Royal Decree has been "wholly repealed".

Regional registration in Andalusia

The judgments distinguish the annulled national register from the regional tourism enabling regime, which falls within the powers of the Autonomous Communities. In Andalusia, the enabling instrument is the responsible declaration before the Andalusian Tourism Register (RTA), which generates the code VUT/MA/XXXXX. This code is the applicable regional identifier for advertising on digital platforms.

Patrimonial liability claim

Since the publication of STS 620/2026 in the BOE (8 June 2026), those who incurred costs related to the NRA (registration fee of €32.73 per property, management expenses, blocked listings, lost bookings) may claim damages from the State through a patrimonial liability claim. The deadline is one year: until 8 June 2027. The procedure is initiated before the Ministry of Finance (Ministerio de Hacienda).
