VUT moratorium Málaga city — no new licences until August 2028

No new VUT can be registered in the city of Málaga until August 2028.
VUTs already registered before the moratorium may continue to operate normally.
Nerja and the Axarquía are not affected.
In August 2025, Málaga City Council approved a moratorium of up to three years on the granting of new Tourist Use Property (VUT) licences across the entire municipal area, as part of an amendment to the General Urban Planning Plan (PGOU).
Scope of the moratorium
During the moratorium period, no new VUT registration application can be processed or granted in the municipality of Málaga, except in very specific cases relating to procedures initiated before the measure was approved.
Already registered VUTs
Properties that already held a VUT licence before the moratorium came into force may continue to operate normally, provided they maintain all requirements set out in the applicable Andalusian regional regulations (Decree 28/2016 and Decree 31/2024).
Affected territory
The moratorium applies exclusively to the municipality of Málaga city. The following territories are not affected and remain open for new VUT registrations:
- Nerja
- Municipalities of the Axarquía
- Rest of the province of Málaga
Legal basis
The moratorium is based on the provision in Decree-law 1/2025 that allows municipalities to exceptionally suspend the granting of new VUT licences during the drafting or revision of urban planning instruments, where there are compelling reasons of general interest related to the availability of residential housing.
Duration
The moratorium has been in force since August 2025 and extends until August 2028, unless the new PGOU comes into force earlier or the city council resolution is expressly amended.
