Decree-law 1/2025 — Urgent VUT measures and urban planning control
Decree-law 1/2025, in force since 4 March 2025, strengthens urban planning coordination between the Junta and local councils regarding VUTs. It allows municipalities to suspend new licences in high-pressure areas and raises the penalty framework. Since it came into force, the Junta has cancelled nearly 10,600 VUTs for urban planning or tourism non-compliance.

Decree-law 1/2025, of 24 February (BOJA no. 41, 03/03/2025), in force since 4 March 2025, introduces urgent measures relating to housing and Tourist Use Properties (VUT) in Andalusia.
Urban planning coordination
The Regional Tourism Ministry notifies the relevant local council of each new VUT registration. If the property is found to be non-compliant with local urban planning regulations, the council notifies the Ministry to proceed with the ex officio cancellation of the tourism registration.
Preventive suspension of new licences
Municipalities where tension between residential and tourist use is evident may exceptionally suspend the granting of new VUT licences during the drafting or revision of urban planning instruments, in order to prevent a pull effect.
Strengthened penalty framework
Very serious infractions for clandestine operation of a VUT may reach €400,000 under the current regime. The future Andalusian Sustainable Tourism Act, currently under parliamentary scrutiny, plans to raise the maximum to €600,000.
Preventive alert system
The Andalusian Tourism Register issues automatic warnings when an attempt is made to register a VUT in areas with urban planning restrictions. This system is currently active in Seville, Málaga, Córdoba, Cádiz, Chiclana de la Frontera and El Puerto de Santa María.
Cancellations since entry into force
Since February 2024, the Junta de Andalucía has cancelled nearly 10,600 VUTs for non-compliance with urban planning or tourism regulations. The province of Málaga records the highest number of cancellations.
